SERVICE AGREEMENT
TERMS AND CONDITIONS OF ENROLLMENT
SERVICE AGREEMENT: Applicant/enrollee agrees to the following terms and conditions: Agreement made by and between the Applicant whose name and address are listed above, hereinafter referred to as the "applicant," and Breyer State University, Inc., whose principal place of business is located at 6080 Center Drive 6th Floor, Los Angeles, CA 90045, hereinafter referred to as the "School".
1. Warranty of Information. Applicant agrees that by submission of this electronic application, the applicant warrants that all the information submitted to Breyer State University is correct to the best of the applicant's knowledge.
2. Time Frame. All applications stay on file for one year from the date of application. After one year the applications are destroyed. The completion time for a course is 15 weeks. The 15 weeks start when the New Student Notification is emailed to the student.
3. Submission of Documents. Applicant agrees to submit in a timely manner, any and all additional supporting documents as may be requested by the School.
4. Purpose. The applicant understands that the purpose of the assessment, and other additional study if required, is for the purpose of issuing a degree as requested by the applicant.
5. Assessment Out-Come. Applicant understands that the applicant may be required to do additional reading, projects or course work if, after an assessment performed by Breyer State University, the applicant fails to achieve enough academic credits to fulfil the degree requirements.
6. Additional Studies. The School reserves the right to add or subtract any courses in any degree program. The School also reserves the right to add or subtract any degree programs, and to change the course content, exams, syllabi, and assignments.
7. Award of Academic Transfer Credits. Students must make a formal request in writing by mail, e-mail or fax, requesting that previous completed college course work be evaluated for transfer credits. Before submitting a request for evaluation, you must have first completed an online application form. There is no charge and no obligation for submitting the application. If we do not have an application on file, we cannot evaluate any request for transcript evaluation. The transferability of credits you at Breyer State University is at the complete discretion of and institution to which you may seek to transfer. Acceptance of the degree or credits you earn at Breyer State University is also at the complete discretion of the institution to which you may see to transfer. If the degree or credits that you earn at this institution are not accepted at the institution to which you seek to transfer, you may be required to repeat some or all of your coursework at that institution. For this reason you should make certain that your attendance at Breyer State University will meet your educational goals. This may include contacting an institution to which you may seek to transfer after attending Breyer State University to determine if your degree or credits will transfer.
8. Limited Liability. Applicant agrees that in no event, shall any liability to the School as a result of this agreement, or other circumstances involving the applicant and School, exceed the applicants tuition and processing fee which has been paid up to the time during which any claim deriving liability may arise.
9. Venue. This agreement shall be construed under the laws of the State of California and any action to enforce the terms and conditions hereof shall be brought before a California state court in the county of Los Angeles County or other such California State county as the School may determine appropriate for the purpose of the School.
10. Refund Policy and Fees. Refunds are granted in accordance with the refund policy listed herein. The school shall issue a refund via postal mail to the applicant as outlined herein within thirty (30) days of receipt of the Signed Notice of Cancellation Form.
A. Students Right to Cancellation: The applicant must submit a signed "Notice of Cancellation Form" as described herein by postal mail or fax. An established link to a printable Notice of Cancellation Form is located in the classroom which may be accessed with the user name and password issued to the applicant after tuition is paid to the School. a) Postal Mail Address: Breyer State University, 6080 Center Drive 6th Floor, Los Angeles, CA 90045. B. Refunds: Pursuant the refund schedule listed below, the time shall commence
from the date in which the applicant was issued a user name and password
by the School. 100% refund - 1st through the 15th day, 50% refund - 16th
through the 30th day 0% refund - after 30 days 0% refund - After 31 days
C. Fee: Applicant understands that the fifty dollar ($50.00) processing fee is a non-refundable fee.
D. Fees: There is a fee of $200 for graduation for all degree programs. There is fee of $15 for each submitted request for official transcripts.
E. Tuition: Tuition for Bachelor degrees is $400 per course. Tuition for Master degrees is $500 per course. Tuition for Doctorate degrees is $550 per course and the Doctoral Project course is $650. Tuition is subject to change at the discretion of the school.
F. Student Tuition Recovery Fund Fee for California Residents Only: There is a fee of $2.50 per $1000 in tuition for all students residing in California only. This fee is non-refundable. To qualify for STRF reimbursement, you must file a STRF application within one year of receiving notice from the BPVE that the school is closed. If you do not receive such notice, you have four years from the date of closure to file an STRF application. If a judgement is obtained, you must file within two years of judgement. More details regarding residency and other requirements and any questions regarding STRF may be directed to the Bureau at 916-431-6959.
G: Students that obtain a loan to pay for an educational program are solely responsible to repay the loan in full plus any interest.
11. Textbooks and Equipment. The only equipment needed is a computer and internet access. Textbooks can be purchased through MBS Direct, Breyer State Universities bookstore or any online bookstore vendor.
12. Tutoring. Breyer State University is an online university with no tutoring services. Students must acquire and pay for any tutoring services.
13. Purchase Statement. Both parties further agree that by the submission of this document through electronic means, no written signature shall be required by either party and that the agreement shall be in effect as of the time and date of submission by the applicant. "I understand that the School (Breyer State University) is not registered with or endorsed by any governmental agency or association, and is not accredited by an accrediting body approved by the United States Department of Education. I understand that courses and curriculums offered by the School may not meet specific state licensing requirements. I understand that I am responsible for ascertaining whether or not course and/or degree programs at Breyer State University will meet any and all licensing, certification, and/or job requirements. I understand that Breyer State University is not a job placement service organization and that there are no services for job placement. I understand that all employers have their own rights to define job requirements and qualifications for jobs and hiring and that Breyer State University does not guarantee job placements or acceptance of courses or degrees by any employers or potential employers.
I further understand that there are no guarantees provided by the School related to acceptance of courses, credits or degrees for entry into or by another school. I understand that each school has rights to establish its own policies, standards and requirements related to acceptance of credits, courses and degrees and I understand that it is my responsibility to ascertain whether or not a school or schools will accept courses, credits or degrees that are earned at Breyer State University. I understand that any courses, credits, or degrees awarded by the School are not accredited by an accreditor that is approved by the US Department of Education, and not accredited by a country’s Department of Ministry of Higher Education.
14. Severance. The provisions of this agreement are independent of each other and are, therefore, severable. If any provision or a part thereof is finally declared invalid by a court of competent jurisdiction, that invalidity shall not affect the validity of any remaining provision or part thereof within this agreement.
Titles/Captions/Headings. Titles, captions, or headings to any provision of this contract are descriptive only and of no legal effect. This agreement has the full force and effect as if no titles existed
15. Entire Agreement. Both parties herein agree that the terms and conditions listed herein constitutes the entire agreement between both parties and that no other verbal or implied conditions or expressed warranties were offered other than those which are listed herein. This agreement supersedes and replaces any prior or contemporaneous agreements, written or oral, relating to this agreement. This agreement may be amended by the School by sending the applicant a thirty (30) day written notice of modification. By applying to the School (Breyer State University) I hereby agree to the following: That all the information contained herein is correct and accurate to the best of my knowledge. I understand that should any information submitted by the applicant be found to be false or misleading, the applicant may be dismissed from enrollment at the School (Breyer State University) and any or all credits granted or earned may be forfeited. That the applicant is eighteen years of age or older or has submitted a parental consent form. I certify that I have received the catalog, school performance fact sheet and information regarding completion rates, placement rates, license exams rates and salary or wage information included in the performance fact sheet. I have read and understand all of the above listed terms and conditions and that this is a legally binding contract and that by submission of this document I agree to all of the above listed terms and conditions. IN WITNESS WHEREOF, the parties have hereunto executed this Service Agreement by means of electronic transmission via the internet on the date transmitted. –with application transmission online, or with printed application.
